Terms and Conditions

These Terms and Conditions govern the services provided by Elevate Editing (“Provider”) to the Client. By commissioning any work, the Client agrees to the terms set out below. Written confirmation of acceptance is required, and a non-response or verbal agreement will be deemed as full acceptance. These Terms apply to any work undertaken for the Client by the Provider.

1. Definitions

 • Job: Each piece of work commissioned by the Client.
• Service: The editing, proofreading, writing, or project management service as defined on the Provider's website or in the Client's brief.
• Freelancer: The self-employed individual providing the service (i.e., the Provider).

2. Agreement of Terms

Prior to commencement, both parties will agree in writing on:


• The service or brief
• Delivery date(s) for submission and return
• Format and method of delivery
• How suggested changes will be presented
• Estimated time for completion
• Availability of the Client to respond to queries
• Agreed fee and expenses (if any)
• Invoicing details

The Freelancer:
• Will work unsupervised using their own equipment
• May invoice periodically for long or multi-stage Jobs

 • Neither party is under obligation to offer or accept work.

3. Copyright and Permissions

The Client confirms in writing that:


• They hold copyright for the content provided or have obtained necessary permissions
• They indemnify the Provider against third-party claims of intellectual property infringement

Unless otherwise agreed:
• Any original content created during editing/writing becomes the Client's copyright
• The Provider may use the Client's name in promotional materials unless otherwise stated in writing.

4. Timetable Slippage

If the Client delays delivery, the Provider may:


• Attempt to reschedule
• Refuse or cancel the Job if rescheduling is impractical OR if the scope changes significantly once the Job begins, the Provider may renegotiate the fee or deadline.

5. Fees and Cancellation

 • Fees are fixed once agreed, unless the text differs significantly from the brief or the scope changes
• Additional tasks requested mid-project may incur additional charges and deadline adjustments
• Cancellation by the Client after one-third completion may incur full charges
• Cancellation by the Provider incurs no charges
• Either party may terminate the contract if a serious breach of these terms and conditions occurs

6. Deposits

 • A deposit (usually 50%) is required for large or long-term Jobs.

7. Payment Terms

 • Invoices are due within 30 days of issue
• Accepted payment: BACS (Bank Transfer)
• Payments must be made in GBP unless otherwise agreed
• Client bears currency conversion or transfer charges
• Payment terms align with the Late Payment of Commercial Debts (Interest) Act 1998 (amended 2002 and 2013)

8. Late Payment

 • Statutory interest (8% above Bank of England base rate) may be applied to overdue invoices, alongside recovery costs.
• Copyright in any work remains with the Provider until full payment is received.

9. Acceptance and Complaints

 • The Provider aims for high-quality, error-minimised work but perfection is not guaranteed
• The Client has 7 days from delivery to raise complaints in writing; non-response is deemed satisfaction
• If work is unsatisfactory, the Provider will rectify it at their own expense
• Disputes will be addressed confidentially and promptly

10. Force Majeure

 • In cases of illness, bereavement, or extraordinary events (e.g. crime, flood), obligations may be postponed or waived.
• A trusted third party will notify the Client if the Provider becomes incapacitated.

11. Insurance and Liability

 • The Provider maintains professional indemnity insurance and secure digital systems
• The Client is responsible for insuring any physical materials in transit
• Legal compliance and responsibility for content remains with the Client
• Subcontracted work (if any) will meet the same standards and confidentiality obligations

12. Waiver

 • Non-enforcement of any term does not constitute a waiver of future rights.

13. Jurisdiction

 • These Terms are governed by the laws of England and Wales. Disputes are subject to the jurisdiction of English and Welsh courts.

14. Right to Refuse Work

 • The Provider reserves the right to refuse or discontinue a project.

15. Portfolio and Acknowledgement

 • The Provider may use completed work in a portfolio unless the Client requests otherwise
• If the Provider has made a substantial contribution, the Client will provide one complimentary hard copy of a publication upon request.

16. Personal Information

The Provider collects and stores:


• Name, email, and optionally a phone number
• Postal address if a Client requires physical documentation

All data is processed in line with the General Data Protection Regulation (GDPR). Both Client and Provider agree that:


• No more personal information will be held than necessary
• Consent to hold/process such data has been requested and obtained
• Each may view the other’s records to ensure accuracy and relevance

 • Unless declined, this information may be shared with a trusted third party in case of emergency. Otherwise, data will not be shared without consent or legal requirement.

17. Confidentiality

• Client confidentiality is respected and protected
• The content and nature of the work will not be disclosed without written permission
• Some cloud storage providers used may be located outside the EU

18. Amendments

 • These Terms may be updated periodically. The most recent revision date is: 20th July 2025. Clients are advised to review them regularly.

We do not gain access to your computer or any files by using cookies. We also do not gain access to any information that you choose not to share with us.

How do we store your personal data?
The minimal information we collect is stored on the following data servers:

 

  • Wix. This is our website host. It is password-protected and has SSL-certification (https) to provide an additional layer of security. You can access Wix privacy policy here.

  • Google Drive. This is our cloud-based file management system accessed via a password-protected computer. You can access Google Drive's privacy policy here.​


How long do we keep your data for?
Because many of our customers and clients work with us more than once, we do not delete data unless specifically requested to do so.
 

  • HMRC requires us to keep records for 'at least 5 years after the 31 January submission deadline of the relevant tax year'. See 'How long to keep your records'.

  • Please ask if you want us to delete or amend your records. As long as we are complying with HMRC's legal requirements, we’ll action your request immediately.
